AI for realtors in Canada
Canadian realtors can use AI for listings, follow-up and admin, but the rules are Canadian: provincial regulators, CREA's REALTOR Code, CASL for messages and privacy law for client data.
The rules that matter, in plain English
| Rule | What it means for AI | Source |
|---|---|---|
| CREA AI principles (June 2026) | CREA set out principles for REALTORS using AI. Read them and use them for your brokerage policy. | CREA |
| RECO AI guidance (Ontario, Oct 2026) | AI doesn't reduce your TRESA duties; verify everything; get written consent before entering personal details or contract terms. | RECO · our checklist |
| TRREB AI do's and don'ts | Board-level guidance for Toronto members. | TRREB |
| CASL | Commercial emails and texts need consent, your identification and an unsubscribe option. | CASL |
| PIPEDA / provincial privacy law | You're accountable for client personal information you put into AI tools. | OPC: PIPEDA · OPC: AI |
| Human rights codes | Ads and rentals can't show a preference based on protected grounds. Ontario's Code covers more grounds than US law. | Ontario Human Rights Code |
Starter prompt: Canadian listing and follow-up rules
You are my assistant. I am a registered real estate [salesperson/broker] with [brokerage] in [city, province]. Use Canadian spelling. Rules: 1. Use only facts I give you; write [CHECK] if anything is missing. 2. Include my brokerage name as registered, as provincial advertising rules require. 3. Human rights: describe the property only. Never refer to age, family status, marital status, religion, ancestry, place of origin, disability, sexual orientation, gender identity or receipt of public assistance. 4. Commercial emails and texts: include my name, brokerage, contact info and an unsubscribe line (CASL). Only write to people I say have consented. 5. No legal, tax or mortgage advice; no value guarantees. 6. Remind me to label AI-altered photos. Confirm, then wait for my first task.
Province by province: where to check
- Ontario: RECO and TRESA with O. Reg. 365/22 (Code of Ethics). See the RECO AI checklist.
- Other provinces: check your provincial regulator and board for AI or advertising bulletins, and CREA's principles.
- Mortgage referrals in Ontario: mortgage brokering is licensed by FSRA; don't let AI give mortgage advice.

Can Canadian realtors use ChatGPT or Claude?
Yes, within your regulator's and brokerage's rules. In Ontario, RECO's October 2026 guidance says AI doesn't reduce your TRESA obligations and asks for written consent before entering client personal details or contract terms.
Does CASL apply to AI follow-up texts?
Yes. CASL applies to commercial electronic messages no matter who or what writes them: you need consent, identification and an unsubscribe option.
Are the free agents Canadian-ready?
Yes. They include CREA and RECO references and a market file where you set your province, spelling and rules.
Is this legal advice?
No. Check your regulator, board and brokerage, and a lawyer for anything specific.
